Published 09/29/2000;

Effective Date October 1, 2000; 65 FR 58613.

SUMMARY: This final rule corrects editorial errors, makes minor regulatory changes, and improves the clarity of certain provisions in the Hazardous Materials Regulations (HMR). The intended effect of this rule is to enhance the accuracy and reduce misunderstandings of the HMR. The amendments contained in this rule are minor editorial changes and do not impose new requirements.

2. RSPA-99-6213 (HM-218); Hazardous Materials; Miscellaneous Amendments; Final Rule;

Published 08/18/2000;

Effective Date October 1, 2000; 65 FR 50450.

SUMMARY: This final rule amends the Hazardous Materials Regulations (HMR) by incorporating miscellaneous changes based on petitions for rulemaking and RSPA initiative. This action reduces regulatory burden on industry where feasible, responds to petitions for rulemaking, and makes other minor adjustments to the regulations to enhance safety and align the HMR with international standards. The intended effect of these regulatory changes is to update, clarify and improve regulatory requirements and provide relief from certain of those requirements where feasible.

3. Office of the Secretary; OST-2000-7761 (Notice No. 00-7); Organization and Delegation of Powers and Duties; Delegations Concerning the Hazardous Materials Transportation Programs;

Published 08/15/2000; 65 FR 49763.

SUMMARY: The Office of the Secretary of Transportation (OST) is updating the delegations of authority from the Secretary to five Operating Administrations and the Associate Deputy Secretary and Director, Office of Intermodalism, in response to the Secretary's determination that hazardous materials safety would be enhanced by placing the focal point for intermodal and cross-modal DOT hazardous materials program issues with the Associate Deputy Secretary. This document revises the current delegations concerning hazardous materials to reflect the primacy of the Associate Deputy Secretary for cross- modal DOT hazardous materials program issues. Further, this rule broadens each Operating Administration's delegations to allow them to use their respective resources for DOT-wide purposes. Additionally, the rule provides the Director of the Bureau of Transportation Statistics with the authority, in coordination with the Associate Deputy Secretary, to work with the Operating Administrations to determine data needs, collections strategies, and analytical techniques appropriate for implementing DOT's hazardous materials program.   1. RSPA-2000-7702 (HM-215D); TITLE:Harmonization With the United Nations Recommendations, International Maritime Dangerous Goods Code, and International Civil Aviation Organization's Technical Instructions; Notice of proposed rulemaking (NPRM); Published 10/23/2000; 65 FR 63293.

    SUMMARY: RSPA proposes to amend the Hazardous Materials Regulations (HMR) to maintain alignment with international standards by incorporating various changes to proper shipping names, hazard classes, packing groups, special provisions, packaging authorizations, air transport quantity limitations and vessel stowage requirements. In addition, RSPA proposes to revise the requirements for intermediate bulk containers and UN portable tanks for alignment with international requirements. Because of recent changes to the International Maritime Dangerous Goods Code (IMDG Code), the International Civil Aviation Organization's Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO Technical Instructions), and the United Nations Recommendations on the Transport of Dangerous Goods (UN Recommendations), these proposed revisions are necessary to facilitate the transport of hazardous materials in international commerce.

  2. RSPA-00-7762 (HM-206C); TITLE:Hazardous Materials: Availability of Information for Hazardous Materials Transported by Aircraft; Advance notice of proposed rulemaking (ANPRM); Published 08/15/2000; 65 FR 49777.

    SUMMARY:RSPA solicits comments and suggestions on ways to implement a recommendation from the National Transportation Safety Board (NTSB) to require that air carriers transporting hazardous materials have the means to quickly retrieve and provide information about the identity of a hazardous material on an airplane. We also solicit comments on the need for this or other changes to the Hazardous Materials Regulations to make it easier for emergency responders to obtain shipment information for hazardous materials transported by aircraft.

  3. HM-212; TITLE:Hazardous Materials: Tank Cars and Cargo Tank Motor Vehicles; Attendance Requirements; Proposed rule; withdrawal ; Published 03/27/2000; 65 FR 16161.

    SUMMARY:RSPA is withdrawing the notice of proposed rulemaking (NPRM) issued in 1992 under this docket on attendance requirements for tank cars and cargo tank motor vehicles. RSPA will address the issues raised in that NPRM, including the proposed rewrite of tank car unloading regulations, in rulemaking under RSPA Docket HM-223 (RSPA-98-4952). The HM-223 rulemaking is intended to clarify the applicability of the Hazardous Materials Regulations to specific functions and activities, including hazardous materials loading and unloading operations.

  4. RSPA-99-6283 (HM-230); TITLE:Hazardous Materials Regulations; Compatibility With the Regulations of the International Atomic Energy Agency; Advance notice of proposed rulemaking (ANPRM); extension of time to file comments; Published 03/01/2000; 65 FR 11028.

    SUMMARY: RSPA is extending for 90 days, until June 29, 2000, the period for filing comments to an advance notice of proposed rulemaking (ANPRM) published under Docket HM-230. RSPA is taking this action in response to a petition filed by the United States Department of Energy (DOE). DOE requested that RSPA allow additional time for interested persons to review and provide comments on the ANPRM and the recent changes contained in the International Atomic Energy Agency (IAEA) publication titled ``IAEA Safety Standards Series: Regulations for the Safe Transport of Radioactive Material, 1996 Edition, Requirements, No. ST- 1'' (hereafter referred to as ST-1).

    SUMMARY: RSPA is considering issuing a notice of proposed rulemaking (NPRM) proposing to amend requirements in the Hazardous Materials Regulations (HMR) pertaining to the transportation of radioactive materials based on recent changes contained in the International Atomic Energy Agency (IAEA) publication, entitled ``IAEA Safety Standards Series: Regulations for the Safe Transport of Radioactive Material, 1996 Edition, Requirements, No. ST-1'' (hereafter referred to as ST-1). The purpose of this rulemaking initiative is to harmonize requirements of the HMR with international standards for hazardous materials. Comments are requested from interested persons concerning the scope of the NPRM, i.e., extent to which differences between the HMR and the IAEA publication ST-1 should be considered in proposing changes to the HMR.
